I will be writing a more detailed article, which will be posted at self-realisation.com in due course, but I am once again fortunate enough to be the bearer of somewhat astonishingly good news for all void mortgagors on these shores; as well as those who so generously donated the fees for our application to the Court of Appeal.
Twenty months after our application to have a void legal mortgage canceled and removed from the Charges Register, Bank of Scotland has withdrawn it legal objection and requested that the Property Chamber, which has been sitting on the application since July 1st 2013, inform the Land Registry, that the existing entries pertaining to their purported legal mortgage, which has been illegally registered for more than 13 years, should be canceled as soon as possible.
Not only has the Land Registry already accepted that it is liable for the losses incurred as a result of this error in the register, this also means that the bank’s LPA Pirates, who have been illegally appointed to manage the property since July 2010, along with two executives of the bank and their unscrupulous solicitors, will now be summonsed to defend charges of fraud by false representation in a private criminal prosecution, which was stayed in July 2013 and will now proceed to trial by jury.
